fa بررسی تطبیقی اصل ضرورت نظامی در حقوق بین‌الملل بشردوستانه و فقه امامیه Comparative study of the principle of military necessity in international humanitarian law & Emamieh jurisprudence حمایت روانی در سوانح Psychological support in disasters پژوهشي Research article مقدمه: «ضرورت نظامی» از جمله مفاهیم به کار رفته در اسناد حقوق بشردوستانه بین¬المللی است. مفهومی پرکاربرد و در عین حال مبهم و غیر شفاف که عدم وضوح معنایی و تبیین نشدن حدود و ثغور آن، موجب بروز و ظهور چالش¬ها و آسیب¬های فراوان در عرصه مخاصمات بین¬المللی و نیز مخاصمات داخلی شده است. این مسئله که «کدام ضرورت» و «با چه کم و کیف» و «با تشخیص کدام متولی»، از جمله مهم¬ترین مسائل چالش برانگیز و مشکل¬سازی است که شفاف نبودن آنها باعث ورود خسارت¬های جبران‌ناپذیر مادی و معنوی بر بشر گردیده و می¬گردد. یافته‌ها نشانگر ضعف و نارسایی این مفهوم و حاکی از این امر است که «ضرورت نظامی» تاکنون دستاویزی برای اعمال سلایق مغرضانه و غیر انسانی برخی فرماندهان نظامی یا مسئولان سیاسی دول متخاصم بوده است. نتیجه بررسی تطبیقی مفهوم «ضرورت نظامی» در فقه امامیه و اسناد بین¬المللی حقوق بشردوستانه، از وجود تفاوت‌های فراوان بین این دو نظام حقوقی حکایت دارد. روش‌ها: روش تحقیق، روشی توصیفی و تحلیلی است و در آن از منابع معتبر فقهی و اسناد بین‌المللی حقوق بشردوستانه بهره¬برداری شده است. یافته‌ها: یافته‌ها حاکی از آن است که «ضرورت نظامی» در اسناد بین‌المللی حقوق بشردوستانه چارچوب مشخص و مدونی ندارد و بیشتر متکی به فهم و برداشت شخصی متولیان مخاصمات بین¬المللی و غیر بین¬المللی است. تحقیقات نشان داده است که فقه امامیه ضرورت نظامی را در قالب و چارچوب نظام¬مند تبیین و تشریح کرده است. نتیجه‌گیری: با بررسی کتب معتبر و دست اول فقه امامیه نظام¬مندی و مبرهن بودن حدود و ثغور مفهوم ضرورت نظامی به اثبات رسید و معلوم گردید که توجه نویسندگان اسناد بین¬المللی به مبانی حقوقی فقه امامیه در این باب می¬تواند در شفاف‌سازی این مقوله بسیار کارساز باشد. Background: "Military necessity" is the concept used in documents of international humanitarian law. This is a widely used, vague and non-transparent concept which does not explain the lack of clarity of meaning and its limits; also it has been caused to emerge enormous challenges in the field of international and internal conflicts. The most important challenging and problematic issues are such as "which necessity", "how" and "who recognizes," which their lack of transparent making irreparable damage on material and spiritual of human. The results indicate the weakness and failure of this concept and suggest that the "military necessity" was an excuse for some inhumane and biased acts of military commanders or political leaders of hostile governments. The comparative study of the concept of "military necessity" in the Emamieh jurisprudence and international humanitarian law documents show that there are many differences between these two legal systems. Methods: This desc riptive and analytical study has been used both the reliable sources of jurisprudence and documents of international humanitarian law. Findings: According to the findings, "military necessity" doesn’t have a specific fr amework in international documents of humanitarian law. This concept is more reliant on personal understandings of custodians of international and non-international conflicts. Emamieh jurisprudence is explained and described the military necessity in the form of a systematic fr amework ba sed on the researches. Conclusion: By studying the reliable first-hand books of Emamieh jurisprudence, the systematic of "military necessity" concept was proved.
